MARSHALL - A Henderson County resident has filed lawsuit claiming that their Dodge pickup truck had a manufacturing defect which caused the truck to fail and crash.
Christopher R. Barker and Kachia D. Barker filed suit against Chrysler Group on Dec. 4 in the Eastern District of Texas, Marshall Division.
The incident occurred on Dec. 15, 2010, as Christopher Barker was operating his 2006 Red Dodge Ram 2005 pickup on Farm-to-Market Road 59 in Henderson County. He was traveling southbound when portions of his Dodge truck failed and caused him to lose control of his vehicle and crash.
According to the lawsuit, the truck’s left tie rod ball, stud or front axle track bar failed. Barker states that many months later the parts at issue were recalled by the defendant.
The defendant is accused of strict product liability, negligence and gross negligence.
Barker is seeking an award of damages for loss of wage earning capacity, mental anguish, physical and mental impairment, disfigurement, medical expenses, loss of consortium, interest, punitive damages and court costs.
The plaintiff is represented by Jimmy M. Negem and Joe M. Worthington of Negem & Worthington in Tyler. A jury trial is requested.
U.S. District Judge Rodney Gilstrap is assigned to the case.
