Farmers in trial for allegedly not paying underinsured motorist benefits

Last September, Port Arthur resident Donald Crane filed suit against his insurance company, Farmers Texas County Mutual, for allegedly not paying underinsured motorist benefits.

On Monday, Dec. 10 jury selection for the case began in a Jefferson County District Court room.

The lawsuit alleges that on Feb. 3, 2009, Crane was traveling west on Liberty Street in Beaumont when Elaine Smith made a left turn from the wrong lane and struck his vehicle.

Crane argues the insurance proceeds he received from Smith’s insurer were insufficient to cover his damages, prompting him to make a policy claim to Farmers for underinsured benefits.

Crane claims he hurt his neck in the incident and is entitled to benefits under the policy for his medical expenses, pain and mental anguish.

Attorney Trenton Bond of the Beaumont law firm Portner Bond represents him.

Beaumont attorney Richard Hatfield of Harris, Duesler & Hatfield represents Farmers.

Judge Bob Wortham, 58th District Court, is assigned to the case.
