Ally Financial receives $8K default judgment in suit over delinquent auto loan

Ally Financial recently received a default judgment worth more than $8,000. 

As previously reported, Ally Financial (GMAC) filed suit against Orange residents George and Tameka Tolliver on May 1 in Jefferson County District Court, seeking to collect on a delinquent auto loan.

Court records show that on Oct. 19 Ally filed a motion for default judgment, stating the defendants have not responded to the suit within the allotted time.

Ten days later, a default judgment was entered, awarding Ally $8,388.88 with interest at the rate of 10.49 percent per annum.

The lawsuit alleges that on April 5, 2008, the couple purchased a 2008 Dodge Avenger from JK Chevrolet. The original amount financed by Ally was $18,692.41.

Although Ally has made demand for payment, the defendants have refused to pay the indebtedness owed.

The plaintiff alleged the defendants breached their contract and sued for actual damages and all court costs.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
