Allen shopping center sued for disability discrimination

SHERMAN - A spinal cord injury victim is suing an Allen shopping center and a Mexigo restaurant for failing to maintain the center in compliance with the Americans with Disabilities Act. 

Leslie Greer filed suit against Silwad Inc. in the Eastern District of Texas, Sherman Division on Dec. 18.

The property is a large mixed-use shopping center with many different types of businesses, including the Mexigo restaurant.

According to court papers, the shopping center was the subject of a previous lawsuit before it was purchased by defendant Silward.

Greer claims that defendants have not complied with the judgment and that the property still does not comply with new construction standards. According to the lawsuit, it does not have handicap accessible parking as required by law, nor does the shopping center have an accessible route through the facility, Greer alleges.

“The defendant in this case has been made aware of this non-compliance for many months and has failed to bring the Property into compliance,” the lawsuit states.

The defendant is accused of violating the Americans with Disabilities Act, failing to accommodate, new construction, improper alterations and discrimination.

Greer is asking the court for an order directing the defendant to stop discriminating against him, and to bring the property into compliance with the new construction standards of the ADA Accessibility Guidelines and Texas Accessibility Standards. He is also seeking an award of damages, attorney’s fees and court costs.

A jury trial is requested.
