Driver says rear-end collision caused injuries

A Jefferson County woman has filed suit against the driver who she claims failed to yield the right-of-way and struck her vehicle.

Tracy Arline claims she was driving in the 4500 block of Dowlen Road near its intersection with the 6000 block of Concord Road in Beaumont on Dec. 8, 2011, when defendant Myrna Jordan attempted to cross from a private driveway to a parking lot on the south side of Dowlen Road. However, while crossing the road, Jordan struck Arline’s vehicle, according to the complaint filed Dec. 26 in Jefferson County District Court.

Because of the collision, Arline sustained neck, back and body injuries; incurred medical costs; experienced mental anguish, physical pain, suffering, disability and physical impairment; and lost her enjoyment of life, the suit states.

Jordan negligently failed to yield the right-of-way, failed to pay attention, failed to keep a proper lookout and failed to timely apply her brakes, the complaint says.

In her complaint, Arline is seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.

Clay Dugas and Malachi Davis of Beaumont will be representing her.

The case has been assigned to Judge Bob Wortham, 58th District Court.
