A payroll services provider claims one of its clients failed to pay more than $30,000 owed to the company.
R&P Employer Solutions and Rodney Robichau filed a lawsuit Dec. 28 in Jefferson County District Court against Kevin Menard and Rifco.
In its complaint, R&P alleges it agreed to begin providing payroll services to the defendants. By December 2010, however, Menard and Rifco had failed to pay R&P for the services provided, according to the suit.
“As of December 6, 2010, the approximate sum owed by Rifco to R&P was $36,880,” the suit states.
On Dec. 6, 2010, Rifco agreed to repay R&P the money it was owed by Dec. 31, 2010, according to the complaint. However, it has failed to do so, the suit states.
R&P alleges breach of contract, fraud and conversion against Rifco.
It seeks a judgment not to exceed the jurisdictional limits of the court, plus actual and consequential damages, attorney’s fees, exemplary damages and other relief the court deems just.
