Lawsuit claims jacked up vehicle fell on top of young boy

GALVESTON - Claiming his minor son injured himself while helping perform vehicle maintenance work, Mariano Diaz II pursues legal action.

A lawsuit filed Jan. 2 in Galveston County District Court blames Kevin Johnson, John Edward Johnson, Johnnie M. Williams and Joe Oran Williams for injuries purportedly sustained by the 7-year-old boy on Jan. 2, 2011.

Recent court documents assert the men instructed the child to help them on a vehicle at a certain location in San Leon.

According to the boy's father, the respondents left him unsupervised just as the jack holding the aforementioned vehicle up gave way and allowed the load to fall on the boy.

The suit states that the younger Diaz suffered "serious personal injuries" and was transported to a nearby hospital for emergency care.

Diaz faults the defendants for:


  • Failing to provide proper supervision and care;

  • Failing to properly secure the vehicle;

  • Failing to warn; and

  • Creating a dangerous condition, an attractive nuisance and high risk of danger and harm for the youngster.


Consequently, the complainant sues for physical pain and suffering, mental anguish, disfigurement, impairment, lost wages and medical expenses.
