Four Port Arthur residents claim they incurred various injuries, including concussions and seizures, after a driver allegedly failed to obey a stop sign and struck their vehicle.
Wilbur Jones, Damien Viltz, Eric Norman and Chaquita Flythe filed a lawsuit Jan. 3 in Jefferson County District Court against Brenda Ford and Ean Holdings.
In their complaint, the plaintiffs allege they were riding in a vehicle traveling north in the 900 block of Highway 69 on Feb. 13, 2011, when Ford, who drove a vehicle owned and insured by Ean Holdings, failed to yield the right-of-way at a stop sign and struck their vehicle.
Because of the collision, the plaintiffs sustained various injuries, including headaches, concussions, seizures, a fractured wrist and neck, back, shoulder, leg and knee injuries, according to the complaint. They also incurred medical costs, lost their earnings and their earning capacities, suffered physical impairment and endured physical pain and mental anguish, the suit states.
They blame Ford for causing the collision, saying she negligently failed to keep a proper lookout, failed to timely apply her brakes, failed to stop or yield to avoid a collision and failed to yield the right-of-way after stopping at a stop sign.
In their complaint, the plaintiffs are asking Ford and Ean to disclose various pieces of material and information, including the correct names of the parties to the lawsuit and the amount of economic damages caused during the collision. They also seek an unspecified judgment, plus interest, costs and other relief the court deems just.
