Total Petrochemicals is asking the court to force plaintiff Jamie Wilton, a Needville resident, to put a maximum dollar amount on his personal injury claim.
As previously reported, the suit was filed Oct. 31 in Jefferson County District Court.
According to the lawsuit, on Dec. 8, 2009, Wilton, a Comear Industries employee, was working at Total’s Port Arthur premises. He was loading sulfur when an unsecure plug being operated by a Total employee struck him in the head.
Court records show on Jan. 11 Total filed special exceptions, requesting that plaintiff be required to amend and plead specifically as to a maximum amount of damages.
Total claims it cannot prepare a proper defense from an “open-ended pleading.”
The suit accuses Total of negligently failing to properly train and supervise its employees.
Wilton is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
Houston attorney Nomaan Husain of Young & Husain represents him.
Total is represented by Houston attorney Michael Wright.
Judge Bob Wortham, 58th District Court, is assigned to the case.
