A Jefferson County resident has filed suit against the driver who he claims struck his vehicle while attempting to make a turn.
Brevin J. Jackson claims he was driving south in the outside lane of the 500 block of Dowlen Road in Beaumont on Sept. 29, 2011, when defendant Seth A. Shimon, who was driving north on the same road, crossed into the turn-only lane and in the southbound lanes. Shimon struck Johnson’s vehicle, forcing Jackson off the road, according to the complaint filed Feb. 21 in Jefferson County District Court.
Because of the collision, Jackson suffered physical pain, incurred medical costs and experienced physical impairment, the suit states.
Shimon negligently failed to drive in a single lane, failed to turn to the left or right to avoid a collision, failed to keep a proper lookout, failed to take proper evasive action, failed to stay alert and failed to timely apply his brakes, the complaint says.
In his complaint, Jackson is seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre-judgment interest, interest at the legal rate, costs and other relief the court deems just.
