Driver sued for allegedly causing collision

A Jefferson County woman claims she suffered injuries after a driver failed to control his speed and struck her vehicle. 

Tracy Gartner filed a lawsuit Feb. 25 in Jefferson County District Court against Sylvester Bell Jr.

In her complaint, Gartner claims she was driving south in the 6600 block of Eastex Freeway Service Road in Jefferson County on Dec. 22 when Bell failed to control his speed and struck her vehicle.

Because of the collision, Gartner incurred medical costs, experienced physical pain and suffering, endured physical impairment and suffered mental anguish, according to the complaint.

She blames Bell for causing the collision, saying he negligently failed to keep a proper lookout, failed to keep a safe distance between his vehicle and hers, drove too fast and failed to timely apply his brakes, the suit states.

In her complaint, Gartner is seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest, costs and other relief the court deems just.

J. Trenton Bond and Chris M. Portner of Portner and Bond in Beaumont will be representing her.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
