Hardin County woman blames driver for causing collision

A Hardin County woman has filed against the driver who she claims lost control of his vehicle, crossing into her lane and causing a collision.

Michelle Burdett claims she was riding in a vehicle traveling west on FM 421 in Hardin County on Nov. 26 when defendant Brian Edward Hawley, who was traveling east on the same road, lost control of his vehicle.

“He (Hawley) crossed into the westbound lane causing the vehicle plaintiff was in to cross into the eastbound lane to avoid a crash,” the suit filed Feb. 25 in Jefferson County District Court states. “In so doing, the vehicle plaintiff was in struck defendant’s right back quarter.”

Because of the collision, Burdett incurred medical costs, experienced physical pain and suffering; endured physical impairment; and suffered mental anguish, according to the complaint.

Hawley negligently failed to keep a proper lookout, drove too fast, lacked proper control of his vehicle, failed to drive in a single lane, made an unsafe lane change and failed to timely apply his brakes, the complaint says.

In her complaint, Burdett is seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest, costs and other relief the court deems just.

J. Trenton Bond and Chris M. Portner of Portner and Bond in Beaumont will be representing her.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
