Texas resident Frank Kulcak is suing Shuan Kulcak and his business, Titan Test Pumps, for injuries he received when he fell off a manlift.
The suit was filed March 5 in Jefferson County District Court.
According to the lawsuit, on Jan. 17 Frank was in the employment of Shuan when he fell from a manlift, “violently impacting a sharp piece of angle iron on the ground below.”
The suit alleges the defendant was negligent but fails to list a specific act of negligence.
The defendant was a nonsubscriber to the Texas Worker’s Compensation Act at the time of the incident.
Franks is asking that the defendant be denied the law defense of contributory negligence.
The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment and lost wages.
