MARSHALL - An employee has filed a lawsuit against his employer claiming that the company breached his employment contract by failing to pay his quarterly bonuses.
Lance Silvertooth filed suit against Danlin Industries Corp. on March 10 in the Eastern District of Texas, Marshall Division.
Silvertooth was employed by the defendant from October 2008 through October 2012. According to the lawsuit, he was under contract to receive a quarterly performance bonus based on a set percentage multiplied by certain revenue achieved by the company.
Silvertooth claims that the defendant began breaching the contract in July 2009 by failing to pay his quarterly bonuses as required.
The plaintiff is seeking an award of actual damages, court costs and interest.
Silvertooth is represented by Russell Scott Cook of The Cook Law Firm in Austin. A jury trial is requested.
U.S. District Judge Rodney Gilstrap is assigned to the case.
