Woman blames driver for causing multi-vehicular accident

A Beaumont woman claims she sustained injuries after a driver caused a multi-car collision. 

Heather Kitchens filed a lawsuit March 6 in Jefferson County District Court against Anthony Lee Smith.

In her complaint, Kitchens alleges she drove in Jefferson County on Nov. 8, 2011, when Smith rear-ended the vehicle behind Kitchens, shoving that automobile into Kitchens’s car.

Because of the collision, Kitchens experienced physical pain, suffering and mental anguish; lost wages and her earning capacity; and endured physical impairment, according to the complaint. She also incurred medical costs, the suit states.

Kitchens blames Smith for causing the collision, saying he negligently failed to look for traffic, failed to control his speed, failed to keep a safe stopping distance, failed to timely apply his brakes, failed to maintain control of his vehicle and failed to adjust his speed for traffic.

In her complaint, Kitchens seeks a judgment for damages in excess of the minimum jurisdictional limits of Jefferson County District Court, plus actual damages, pre- and post-judgment interest at the highest amount allowed by law, costs and other relief the court deems just.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
