A Jefferson County man has filed suit against the Port Arthur driver who he claims failed to yield the right-of-way and caused a collision.
Richard Delaconcha claims he was driving in Jefferson County on Nov. 16 when defendant Merrie Verret Montondon failed to yield the right-of-way and struck his vehicle.
Because of the collision, Delaconcha experienced physical pain and suffering; incurred medical costs; lost earnings; and suffered physical impairment and disfigurement, according to the complaint filed March 13 in Jefferson County District Court. He also suffered emotional distress and lost his ability to enjoy life, the suit states.
Montondon negligently failed to keep a proper lookout, drove too fast, failed to yield the right-of-way, lacked proper control, failed to control her speed and failed to timely apply her brakes, the complaint says.
In his complaint, Delaconcha seeks a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest, costs and other relief the court deems just.
John Werner of Reaud, Morgan and Quinn in Beaumont will be representing him.
The case has been assigned to Judge Gary Sanderson, 60th District Court.
