Phlebotomist files pregnancy discrimination lawsuit

SHERMAN - A phlebotomist has filed a discrimination lawsuit against her former employer claiming that she terminated from her position due to her high risk pregnancy.

Sodonia Rodgers filed suit against Professional Clinical Laboratory Inc., also known as ProLabInc., and Medstaff Services LLC on March 21 in the Eastern District of Texas, Sherman Division. 

Rodgers began working for the defendant ProLab on Oct. 5, 2010 and was discharged on April 26, 2012. At the time of her discharge, she was employed as a phlebotomist.

According to the lawsuit, in March 2012, she accepted a new position with the company which made her area of responsibility to include the Euless area, which is approximately 90 miles from her Sherman home. By April, her physician had advised her that due to her risk of miscarriage she should not be more than 60 miles from his Sherman office, for her safety and the safety of her unborn child.

Rodgers claims she informed her employer of the necessary changes and was told that she could work part-time, take a four-week personal leave or she resign.

Rodgers states that the defendant was unwilling to make accommodation for Plaintiff to meet her doctor’s recommendation and could have made the accommodation by returning her to her previous position in the Sherman/Denison area.

The defendant is accused of unlawful employment practices which include pregnancy discrimination, and retaliation for reporting discrimination in workplace, and violations of the Americans with Disabilities Act.

The plaintiff is asking for an award of damages for mental anguish, punitive damages, attorney’s fees, court costs and interest.

Rodgers is represented by Sherman attorney Ronald R. Huff. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
