Galveston motorist sued over summer 2012 wreck

GALVESTON - In response to an alleged two-vehicle wreck in Galveston last year, Tabitha and Gavin Jennings pursue legal action.

A lawsuit filed March 21 in Galveston County Court at Law No. 2 states that local resident Kathleen McBride Ferguson caused the Aug. 9, 2012 accident involving the plaintiffs. 

The suit shows that Tabitha Jennings, with Gavin Jennings as her passenger, was driving eastbound on Avenue N when they encountered Ferguson.

According to court papers, Ferguson was traveling southbound on 17th Street when she ignored a stop sign and subsequently hit the complainants' vehicle.

The Jennings claim the subject collision left them "severely" injured, insisting they did nothing to bring forth the occurrence in question.

Ferguson is faulted for:


  • Failing to maintain a proper lookout;

  • Failing to apply her brakes;

  • Failing to bring her vehicle to a stop before colliding with the complainants;

  • Failing to control her speed;

  • Failing to obey a stop sign; and

  • Failing to yield the right of way to oncoming traffic.


Consequently, the plaintiffs sue for physical pain, mental anguish, medical expenses, lost wages, property damage and loss of use.

They are represented by attorney David L. Hutchins of Midani Hinkle & Cole LLP in Houston.

Galveston County Court at Law No. 2 Judge Barbara Roberts is presiding over the case.
