An Orange County man has filed suit against the allegedly intoxicated driver who he claims rear-ended his vehicle.
Sean O’Bannion claims he was driving north in the 2300 block of Eastex Freeway on Feb. 10 when defendant Mark Robin allegedly failed to control his speed and struck the back of O’Bannion’s vehicle.
Because of the collision, O’Bannion incurred medical costs; lost wages and his earning capacity; suffered mental anguish, physical pain and suffering; and endured physical impairment, according to the complaint filed March 20 in Jefferson County District Court.
Robin negligently failed to keep control of his vehicle, failed to keep a proper lookout, failed to timely apply his brakes, failed to drive within a single lane and drove while intoxicated, the suit states.
O’Bannion is seeking actual and exemplary or punitive damages, plus pre-judgment interest, costs and other relief the court deems just.
He will be represented by Clay Dugas and Malachi Daws of Clay Dugas and Associates in Beaumont.
The case has been assigned to Judge Milton Shuffield, 136th District Court.
