Bookkeeper sues home health agency for overtime wages

SHERMAN - A bookkeeper for a home health agency has filed a lawsuit against her former employer claiming that she was not paid for the overtime hours she worked. 

Carol Reyes filed suit against Grace Home Health Inc. on April 3 in the Eastern District of Texas, Sherman Division.

Reyes worked for the defendant from Jan. 19, 2008, until February 2013 as a supervisor and a bookkeeper.  She claims that during her employment with the defendant, she worked in excess of forty hours and was not paid for her overtime hours.

The defendant is accused of violating the Fair Labor Standards Act, which prohibits the denial of overtime compensation for hours worked in excess of 40 per workweek.

The plaintiff is seeking an award of actual and compensatory damages, liquidate damages, attorney’s fees, interest and court costs.

Reyes is represented by Charles L. Scalise of Ross Law Group in Austin and John F. Polewski of Polewski & Associates P.C. in DeSoto. A jury trial is requested.

U.S. District Judge Ron Clark is assigned to the case.
