GALVESTON - One of the defendants in a Kemah physician's lawsuit over sale proceeds has countered his allegations, recent court records show.
League City local Pamela Morgan submitted a two-page original answer into Dr. Stephen Sayers's late 2012 lawsuit on March 21.
Sayers sued Morgan and her husband on Oct. 24, 2012, in Galveston County 56th District Court after the couple's apparent failure to remit $118,245 in exchange for his practice, South Shore Harbour Family Practice.
The original petition explains that the parties executed an agreement for the property in question in October 2004, but the plaintiff asserts the buyers “had no intent to make any of the contractually agreed upon quarterly payments.”
The Morgans reportedly defaulted on the first quarterly payment that was due on Jan. 4, 2005 and Scott Morgan explained to the plaintiff that the some of the funds were “mistakenly deposited into the bank account of [Dr. Sayers's] ex-wife.”
According to the suit, the respondents then defaulted a second time with their last payment dating back to Oct. 2, 2010.
Pamela Morgan denied the doctor's claims nearly six months after she and her spouse were served.
Her rebuttal asserts that the suit is barred by the statute of limitations and claims offset for payment of other expenses "required to be paid by the plaintiff pursuant to the contract."
She is representing herself.
