Total Petrochemical settles injury suit for $27K

Total Petrochemicals has agreed to settle Jamie Wilton’s personal injury claim for $27,000. 

As previously reported, the suit was filed Oct. 31, 2011, in Jefferson County District Court.

According to the lawsuit, on Dec. 8, 2009, Wilton, a Comear Industries employee, was working at Total’s Port Arthur premises. He was loading sulfur when an unsecure plug being operated by a Total employee struck him in the head.

Court records show that on Feb. 14 a letter was filed in case stating that the letter confirms and serves as a Rule 11 Agreement that the cause is settled for $27,000.

The suit accuses Total of negligently failing to properly train and supervise its employees.

Wilton was suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Houston attorney Nomaan Husain of Young & Husain represents him.

Total is represented by Houston attorney Michael Wright.

Judge Bob Wortham, 58th District Court, is assigned to the case.
