An agreed order of dismissal with prejudice has been entered in a personal injury lawsuit against Total Petrochemical USA.
As previously reported, Beaumont resident Clinton Williams filed suit against Total Petrochemical on Sept. 26, 2011, in Jefferson County District, claiming moving heavy equipment created an unreasonable risk of harm and caused him injury.
Court records show the order was filed Nov. 1 and states the Williams announced to the court that he no longer wished to pursue his claims.
The lawsuit alleged that on Feb. 18, 2010, Williams, a Phillips Services employee, was operating a vacuum truck at Total’s premises to remove wastewater when the drain became clogged.
Williams and a co-worker were instructed by their supervisor to use Total’s pump, which weighed approximately 200 pounds. While attempting to move the pump onto an elevated area, Williams injured himself.
The suit does not state how Williams was injured, but does allege that Total should have known that it was unreasonably dangerous to lift heavy equipment without the proper tools and manpower.
Williams was suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Judge Gary Sanderson, 6oth District Court, presided over the case.
