Minor blames drivers for rear-ending her vehicle

A minor has filed suit against the drivers who she says rear-ended her vehicle. 

Savannah Simon claims she was stopped at the 900 block of Dowlen Road near its intersection with the 6700 block of College Street in Beaumont on Oct. 25 at about 7:50 a.m. when defendants Tabitha Cormier and Kelly Vargas struck her vehicle.

Because of the collision, Savannah Simon suffered head, back and leg injuries; experienced severe physical pain, mental anguish and physical impairment; and incurred medical costs, according to the complaint filed April 5 in Jefferson County District Court. She also missed time from school while her father, Chad Simon, missed time from work to care for her, the suit states.

Cormier and Vargas negligently failed to control their speeds, failed to keep proper lookouts, failed to timely apply their brakes, failed to take proper precautions to control their vehicles, failed to drive in a reasonable manner, drove inattentively, failed to take account of traffic, drove in a reckless manner, drove too fast and failed to take evasive action to avoid a collision, the complaint says.

In her complaint, Savannah Simon is seeking an unspecified judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.

John S. Morgan of Morgan Law Firm in Beaumont will be representing her and her father.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
