SHERMAN - A Collin County man has filed a lawsuit against a debt collector for threatening to send the sheriff to his home in order to collect on a debt.
Edward Pritzkau filed suit against Commercial Recovery Systems Inc., John Does and Jane Does on April 8 in the Eastern District of Texas, Sherman Division.
According to the lawsuit, Pritzkau developed a financial obligation in connection with a personal or family obligation, which was transferred to the defendants for collection. The defendants allegedly threatened to garnish Pritzkau’s wages and have a sheriff sent to his home to take his assets. Pritzkau claims that these statements were made while the defendant demanded immediate payment.
The defendant is accused of violating the Fair Debt Collection Practices Act, which prohibits debt collectors from engaging in abusive, deceptive and unfair practices.
The plaintiff is seeking an award of actual damages for emotional distress, anger, anxiety, embarrassment, humiliation, frustration, and upset, statutory damages, court costs and attorney’s fees.
Pritzkau is represented by Kevin Crick of Consumer Rights Law Firm in Andover, Mass. A jury trial is requested.
U.S. District Judge Ron Clark is assigned to the case.
