A worker alleging a metal clamp fell on his face has non-suited Betco Scaffold Erection Company from his action.
As previously reported, Gerald Greer filed a suit against his employer, Chemtrade Refinery, and contractors Newtron and Betco Scaffold, on Sept. 9, 2011, in Jefferson County District Court.
On Sept. 25, 2012, Greer filed a notice of non-suit with prejudice for his claims against Betco Scaffold, court papers say.
The following day, Judge Gary Sanderson, 60th District Court, ordered that Greer’s claims against the company be dismissed with prejudice.
Court records also show Greer and Newtron reached a tolling agreement on March 30, 2012, non-suiting Newtron without prejudice.
The agreement allows Greer to reinstate his claims against Newtron, even if the statute of limitations lapses.
In his suit, Greer claims he was working at defendant Chemtrade Refinery Services’s facility on Jan. 26, 2010, when the metal clamp fell on his face.
He alleges the defendants negligently failed to correct the dangerous condition and failed to warn him.
Greer is seeking damages within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest, costs and other relief the court deems just.
