A joint motion to dismiss was recently granted in litigation brought by Kris Pitre, who sued Duphil Inc. after a bumpy ride on a marsh buggy owned by the company.
As previously reported, the suit was filed Aug. 31, 2011, in Jefferson County District Court.
On March 22 the parties filed the motion, stating that they had reached a settlement, court papers say.
Judge Gary Sanderson, 6oth District Court, granted the motion four days later.
According to the lawsuit, on Sept. 8, 2010, Pitre was a passenger in a buggy being driven by a Duphil employee.
“The Marsh Master buggy rode over uneven ground forcefully thrusting plaintiff forward, causing his left shoulder to strike a rail,” the suit states.
The suit also alleged that Duphil is responsible for Pitre’s injury because the company negligently removed the buggy’s seatbelts.
Duphil had contracted with Pitre’s employer, Dean Equipment, to clean a marsh located in LaBelle.
Pitre was suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
