Roxton woman sues Kroger after slipping on grapes

SHERMAN - A Roxton resident has filed a lawsuit against a grocery store claiming that she suffered injuries when she slipped on a grape and fell.

Yvonne Moore filed suit against The Kroger Co. on Jan. 9 in Lamar County District Court. The defendant removed the case to the Eastern District of Texas, Sherman Division on April 12. 

The incident occurred on June 18, 2011, as Moore was shopping for groceries in the Kroger store located in Paris, Texas. While walking through the produce section, Moore claims she stepped on some grapes that were on the floor, causing her to lose her footing and fall to the floor, striking her knee.

The defendant is accused of negligence for failing to properly inspect and maintain the floor area in question to discover the dangerous condition, failing to maintain the floor in a reasonably safe condition, failing to give adequate warnings and failing to discover and remove the grapes within a reasonable time.

The plaintiff is seeking an award of damages for medical care and expenses, physical pain and suffering, mental anguish, physical impairment, loss of earnings, interest and court costs.

Moore is represented by Paris attorney Rick Standifer.

U.S. District Judge Richard A. Schell is assigned to the case.
