McDonald's target of Houston man's sexual harassment lawsuit

HOUSTON - Alleging McDonald's Restaurants of Texas Inc. terminated him for speaking out against sexual harassment, Houston resident David Maynard pursues legal action.

A lawsuit filed April 19 in the Houston Division of the Southern District of Texas asserts Maynard's immediate supervisor made inappropriate advances toward him when he worked at the defendant's restaurant on Rankin Road in North Houston.

The suit explains that the store manager occasionally made references to the plaintiff's private parts and once leaned over to him with her blouse unbuttoned.

Said manager, who is married, purportedly tried to get Maynard, who is also married, to have an affair with her, the original petition says.

Maynard first notified the district manager of his superior's behavior to no avail as the latter laughed the allegations off and chided the complainant for being "too serious."

The plaintiff then took his grievances up with a representative from the respondent's human resource department.

His complaints reportedly fell on deaf ears.

The manager who Maynard says mistreated him fired the plaintiff from the eatery.

Despite his dismissal, human resources notified the complainant that he was still in the system, but purportedly threatened him with actual termination if he hired an attorney.

McDonald's officially fired Maynard on Feb. 28, 2011.

He consequently seeks unspecified monetary damages and a jury trial.

Attorney Daryl J. Sinkule of Shellist Lazarz Slobin LLP in Houston is representing the plaintiff.
