Driver blamed for causing rear-end collision

A Montgomery County woman claims she sustained more than $100,000 in damages after a driver rear-ended her vehicle. 

Judy Anderson filed a lawsuit April 11 in Jefferson County District Court against Michael Robert Krieg, ADT LLC doing business as ADT Security Services, Tyco Integrated Security, Wheels LT and Wheels.

In her complaint, Anderson claims she drove her maroon 2004 GMC Envoy east on Texas State Highway 73 in Port Arthur on May 5, 2011, when she saw that traffic in front of her was stopped.

She applied her brakes and changed lanes when Krieg, who was driving a white 2009 Chevrolet Silverado pickup truck owned by Wheels LT and Wheels, collided into the back of the Envoy, according to the complaint.

Because of the collision, Anderson suffered physical pain and mental anguish, endured disfigurement, sustained physical impairment and incurred medical costs, the suit states. She also incurred costs of more than $100,000, the complaint says.

Anderson blames Krieg for causing the collision, saying he negligently failed to timely apply his brakes, failed to keep a proper lookout, failed to swerve to the left or right to avoid a collision, failed to yield the right-of-way, drove too fast and failed to control his speed.

Anderson names ADT, Tyco, Wheels LT and Wheels as defendants because they entrusted their vehicle to Krieg, who they should have known to be an unlicensed, incompetent and reckless driver.

In her complaint, Anderson seeks a judgment of more than $100,000, plus costs, pre- and post-judgment interest and other relief the court deems just.

William W. Durham and Mance Michael Park of Park and Durham in Huntsville will be representing her.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
