Couple sues Deer Park motorist over local accident

GALVESTON - An area accident almost two years ago has resulted in a lawsuit.

Cynthia Gaar and Francis P. McCullough Jr. are suing Deer Park resident Colton Dane Henderson for the May 31, 2011, incident.

According to recent court documents filed May 20 in Galveston County District Court, Henderson drove in the wrong lane of traffic and crashed into the vehicle driven by McCullough with Gaar as a passenger.

The couple asserts that they suffered personal injuries and have sought and received medical care and treatment.

Their insurer, Government Employees Insurance Company, is a co-defendant in the case.

"This insurance policy contains underinsured insurance coverage and the plaintiffs have met all of the conditions precedent for making a claim under that policy," the original petition says.

The plaintiffs additionally insist they are entitled to their underinsured benefits because they have paid premiums in the past.

Consequently, they sue for physical pain and impairment, mental anguish, lost wages and medical expenses.

Attorney John P. Venzke of The Venzke Law Firm in Houston is representing the complainants, and Galveston County 10th District Court Judge Kerry L. Neves is presiding over the litigation.
