HOUSTON - Harris County resident Tina Roshea Hayes claims her termination from Atria Management Co. LLC Inc. was steeped in racism and has initiated litigation against her former employer.
Hayes filed a lawsuit May 21 in the Houston Division of the Southern District of Texas.
The plaintiff, who was hired in May 2010, explains that the retirement facility began to mistreat her in July 2012.
At that time, according to court papers, a contract worker for the defendant told Hayes that one of its patients stated that she had been raped.
Hayes immediately relayed the information to her supervisor on duty as well as her direct supervisor, and was instructed to write a statement.
She was summoned by her supervisor on Aug. 3, 2012, to learn she was being terminated, the original petition says.
The complainant, who is black, further asserts there were "very" few African-Americans working for the respondent, "especially in upper management."
"The defendant has a history of treating its African-American employees in a discriminatory manner by denying upper level positions to African-Americans," the suit says.
"The defendant made the working conditions so intolerable that the plaintiff felt compelled to resign her position."
Hayes insists the respondent's purported conduct "was extreme and dangerous" to where it caused her "severe" emotional distress.
A jury trial is requested.
