Caregiver files lawsuit claiming she was not paid minimum or overtime wages

SHERMAN - A Dallas County caregiver has filed a lawsuit claiming she was not paid minimum wages or paid overtime wages.

Renita Baker filed suit against ABC Provider DFW and James Forbes on May 23 in Eastern District of Texas, Sherman Division.

Baker worked for the defendants from July 2012 through May 2013 as a caregiver.  She claims that the defendants intentionally failed to pay her the federally mandated minimum wage and failed to pay her overtime wages.

The defendant is accused of violating the Fair Labor Standards Act.

The plaintiff is seeking an award of actual and compensatory damages for unpaid minimum wages and overtime compensation, liquidated damages, court costs, interest and attorney’s fees.

Baker is represented by Charles L. Scalise of Ross Law P.C. in Austin. A jury trial is requested.
