TYLER - A promotional event company has filed a lawsuit against a trailer manufacturer claiming that it breached its contract by providing a trailer with major design problems.
Automotive Driving Solutions Ltd. filed suit against BlueRidge Trailers Inc. on May 23 in Eastern District of Texas, Tyler Division.
In March 2012, Automotive Driving Solutions desired to add a new trailer to its fleet and contracted with the defendant to manufacture, build, assemble, provide, sell and deliver a new 2012 BlueRidge aluminum trailer for the sum of $160,000. The defendant issued an invoice and stated the trailer would be ready for shipping in April 2012.
The plaintiff argues the trailer was delivered late and has major design problems, including equipment and component malfunctions relating to the breakers, generators, light fixtures and wiring; unsafe welds and decking, non-matching tires, a faulty fuel tank, a leaky roof and other malfunctions.
The defendant is accused of breach of contract and negligence.
The plaintiff is asking the court to order a rescission of the contract and an award of damages for $250,000, plus interest, court costs and attorney’s fees.
The plaintiff is represented by attorney Mark F. Kruse of Cleveland, Ohio, and Matthew B. Flanery of Grant & Flanery P.C. in Tyler.
U.S. District Judge Michael H. Schneider is assigned to the case.
