SHERMAN - A quick lube technician has filed a lawsuit against his former employer claiming he was not paid overtime wages.
Christopher Whitfield filed suit against Ray Huffines Chevrolet Inc. on May 26 in Eastern District of Texas, Sherman Division.
Whitfield worked for the defendant from July 2010 through December 2011 as a quick lube technician. He claims that during the weeks that he worked overtime hours, he was not paid one and one-half times his regular rate for each overtime hour worked.
The defendant is accused of violating the Fair Labor Standards Act, which prohibits the denial of overtime compensation for hours worked in excess of 40 per workweek.
The plaintiff is seeking an award of damages for overtime compensation, liquidated damages, attorney’s fees, court costs and interest.
Whitfield is represented by Charles L. Scalise of Ross Law Group in Austin. A jury trial is requested.
U.S. District Judge Richard A. Schell is assigned to the case.
