Harrison County woman sues after car wreck in Louisiana

MARSHALL - After being involved in a car wreck in Louisiana, a Harrison County woman has filed a lawsuit against an Alabama man and his employer claiming that the wreck was caused by negligent entrustment.

Whitney Burrow, on behalf of herself and as next friend of her minor son, filed suit against David Ponder and Landstar Ranger Inc. on May 2 in Harrison County District Court. The defendant removed the case to the Eastern District of Texas, Marshall Division.

According to the lawsuit, the plaintiffs were traveling eastbound on Greenwood Road in Caddo Parish in Louisiana when the defendants failed to yield the right of way and collided into the front of the Burrow vehicle.

Defendant David Ponder is accused of negligence for failing to keep a proper lookout, failing to yield, failing to turn his motor vehicle in an effort to avoid the collision, failing to keep such a distance away from the Burrow vehicle, failing to timely apply his brakes, failing to stop, yield and grant immediate use of the intersection to conform to Burrow and for failing to enter into the intersection only when he could have safely entered without interference or collision with other traffic.

Defendant Landstar Ranger is accused of negligent entrustment.

The plaintiff is seeking an award of damages for medical expenses, pain and suffering, physical impairment, loss of earnings, loss of earning capacity, interest and court costs.

Burrow is represented by Marshall attorney Josh B. Maness.

U.S. District Judge Rodney Gilstrap is assigned to the case.
