TYLER - A Texas man has filed a lawsuit claiming he suffered "life-altering" injuries when a North Carolina man crashed into the rear of his vehicle.
Timothy Harmon filed suit against Justin Wilcox, JBS Carriers Inc. and Miller Brothers Co. Inc. on April 16 in Smith County District Court. The defendant removed the case to the Eastern District of Texas, Tyler Division.
The accident occurred on May 9, 2011 as defendant Wilcox crashed into the rear of Harmon’s vehicle.
Defendant Wilcox is accused of negligence for failing to keep a proper lookout, failing to control his speed, failing to make timely application of brakes, driving too fast for the conditions then existing, failing to reduce his speed, and for operating his vehicle in an unsafe and improper manner.
Defendants JBS Carriers and Miller Brothers Co. are accused of negligent hiring, training, retention and supervision.
The plaintiff is seeking an award of $3 million in damages for medical expenses, pain and suffering, mental anguish, disability and impairment, disfigurement, exemplary damages, interest and court costs.
Harmon is represented by Jason B. McMinn and Justin D. McMinn of McMinn Law Firm in Austin. A jury trial is requested.
