Plano man sues State Farm agent for telephone harassment

SHERMAN - Claiming telephone harassment, Plano resident Roger Fountain has filed a lawsuit against Ed Enriquez, doing business as a State Farm agent, on Jan. 17, 2013, in Small Claims Court of Collin County. The defendant removed the case to the Eastern District of Texas, Sherman Division on June 12. 

Fountain claims the defendant violated the Texas state and National Do Not Call Registries, violations of the Fair Collection Practices Act and phone harassment.

According to the lawsuit, Enriquez did not contact Fountain but an Instant Insurance Marketing telemarketing service did. Fountain allegedly gave permission to be contacted by third-party business partners and agreed to proceed with an auto insurance quote, which he was transferred to the State Farm office.

Fountain is asking for an award of $5,000 and is acting as his own attorney.

U.S. District Judge Ron Clark is assigned to the case.
