GALVESTON - Area resident Spiros Charalambous blames Friendswood local Katherine E. Cooper for a July 2012 vehicular accident involving the two of them, recent court documents say.
Charalambous filed a lawsuit against Cooper on June 13 in Galveston County District Court, claiming she rear-ended him in Houston on July 5, 2012.
The suit states that the plaintiff was stopped at a red light at the intersection of Interstate 45 and Dixie Farm Road, adding he was waiting to make a left turn.
He caught a green light, but was forced to wait for an 18-wheeler that was also turning and was in need of additional turning room.
It was during that time, according to the original petition, when Cooper struck the back of the complainant's vehicle.
"Upon impact, the plaintiff's vehicle was damaged and the plaintiff received severe, disabling injuries," the suit says.
Cooper is faulted for:
- Failing to control her speed;
- Failing to keep a proper lookout;
- Failing to safely operate her vehicle on the roadway;
- Failing to take proper evasive action;
- Failing to act as a prudent driver;
- Failing to veer to the right or to the left to avoid colliding with the plaintiff's vehicle; and
- Failing to travel at a safe rate of speed so as to be capable of stopping.
Consequently, Charalambous seeks unspecified monetary damages and a jury trial.
Attorney Darrell A. Apffel of Bettison, Doyle, Apffel & Guarino P.C. in Galveston is representing the complainant, and Galveston County 10th District Court Judge Kerry L. Neves is presiding over the litigation.
