Driver blamed for slamming into passenger side of vehicle

A woman has filed suit against the driver who she claims disregarded a red traffic light and struck the passenger side of her vehicle. 

Deena Foreman Holcomb claims she attempted to drive through the intersection of State Highway 347 and Parkway Street on Jan. 3, 2012, when her light turned green. However, as Holcomb was driving through the intersection, defendant Hien Thy My Nguyen, who was driving north, disregarded the red light and struck the passenger side of Holcomb’s vehicle, according to the complaint filed June 21 in Jefferson County District Court.

Because of the collision, Holcomb suffered cervical neck pain, bilateral shoulder pain, back pain, a closed head injury and right ankle pain and incurred medical costs, the suit states. She also experienced physical pain, suffering and mental anguish and lost earnings, the complaint says.

Holcomb blames Nguyen for causing the collision, saying he negligently failed to keep a proper lookout, failed to obey traffic signals, failed to avoid the incident, failed to maintain his vehicle and failed to drive as a reasonable person would have.

Truong Van Le is also named as a defendant. Le lent Nguyen the car he was driving when the collision occurred, according to the complaint.

In her complaint, Holcomb is seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest at the highest legal rate, actual damages and other relief the court deems just.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
