SHERMAN - A Richardson man has filed a lawsuit against a department store for violating federal law by calling his cellular telephone.

David Humphreys filed suit against Kohl’s Department Stores Inc. on June 27 in the Eastern District of Texas, Sherman District. 

The defendant allegedly contacted Humphreys by contacted his cellular telephone on Jan. 1, 2013. Kohl’s allegedly used an automated telephone dialing system and/or artificial or pre-recorded messages.

Humphreys states he had no previous business relationship with the defendant and did not give consent to be contacted. He spoke with a live representative around February 2013 and requested for the telephone calls to stop. Despite the requests, the telephone calls continued.

The defendant is accused of violating the Telephone Consumer Protection Act.

The plaintiff is seeking an award of statutory damages and treble damages.

Humphreys is represented by Jody B. Burton of Lemberg & Associates in Stamford, Connecticut. A jury trial is requested.

U.S. District Judge Richard S. Schell is assigned to the case.
