Desk clerk sues for minimum wages and overtime wages

SHERMAN - A desk clerk has filed a lawsuit claiming she was not paid the federally mandated minimum wage or paid overtime wages. 

Claiming violations of federal law, Raschelle Martin filed suit against Shree Lakshmi Corp. on June 26 in the Eastern District of Texas, Sherman Division.

Martin worked for the defendants from April 29, 2013, through May 26, 2013, as a desk clerk.

During the weeks that Martin worked overtime hours, the defendant is accused of intentionally failed to pay Martin one and one-half times her regular rate of pay for each overtime hour worked. Martin also claims that she did not receive the applicable minimum wage for all hours worked during the week.

The defendant is accused of violating the Fair Labor Standards Act.

The plaintiff is seeking an award of actual and compensatory damages, liquidated damages, attorney’s fees, court costs, and interest.

Martin is represented by Charles L. Scalise of Ross Law Group in Austin. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
