A Louisiana woman claims a podiatrist failed to adequately treat her condition and to provide her with requested X-rays.
Cheryl Hoffpauir and Thaddeus Tatus Hoffpauir filed a lawsuit June 20 in Jefferson County District Court against Dr. Joseph Novosel.
In their complaint, the Hoffpauirs allege Cheryl Hoffpauir visited Novosel for surgery on her right foot on April 11, 2011. The doctor was supposed to remove a boney enlargement on her toe, according to the complaint.
Following the procedure, however, Cheryl Hoffpauir suffered from extreme pain and had to revisit Novosel frequently. In fact, she required three additional surgeries on her foot, the suit states.
After enduring four surgeries over the course of nine months, Cheryl Hoffpauir elected to get a second opinion. During that visit, she learned that Novosel had not adequately treated her condition, the complaint says.
In August 2012, Hoffpauir requested her medical records and X-rays from Novosel. Along with the request, she claims she mailed in a check for $152.50. Although the check was cashed, Cheryl Hoffpauir never received her X-rays, she claims.
In their complaint, the Hoffpauirs allege negligence and breach of contract against Novosel.
They seek a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest at the legal rate, costs, attorney’s fees and other relief the court deems just.
