Receptionist sues for overtime wages

SHERMAN - A receptionist has filed a lawsuit against his employer claiming violations of the Fair Labor Standards Act for not paying him overtime wages.

Darvin Carson filed suit against I.T.S. Academy Inc. on June 30 in the Eastern District of Texas, Sherman Division. 

Carson worked for the defendant from April 2011 through May 2013 as a receptionist. He claims that during his employment he worked in excess of 40 hours per week and was not paid overtime wages.

The defendant is accused of violating the Fair Labor Standards Act, which prohibits the denial of overtime compensation for hours worked in excess of 40 per workweek.

The plaintiff is seeking an award of actual and compensatory damages, liquidated damages, attorney’s fees, court costs and interest.

Carson is represented by Charles L. Scalise of Ross Law Group in Austin. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
