SHERMAN - A Denton County woman has filed a lawsuit against Florida debt collection law firm claiming the law firm called her offensive names and told her she committed felony theft.
Karen Petty filed suit against Underwood James & Associates on July 23 in the Eastern District of Texas, Sherman Division.
Petty states that the defendant attempted to collect on a debt by using an abusive language and told Perry that it was filing “felony theft charges.” The defendant also failed to state in a voicemail communication that it left that it was a debt collector.
The defendant is accused of violating the Fair Debt Collection Practices Act, which prohibits debt collectors from engaging in abusive, deceptive and unfair practices.
The plaintiff is seeking an award of damages for emotional distress, statutory damages, court costs and attorney’s fees.
Petty is represented by Kevin Crick of Consumer Rights Law Firm in Andover, Mass. A jury trial is requested.
U.S. District Judge Ron Clark is assigned to the case.
