Two women have filed suit against the driver who they claim rear-ended their vehicle, causing them to sustain physical pain and mental anguish.
Katiusca Medina and Giulia Rispetti claim Medina was driving south in the 6100 block of the Eastex Freeway in Beaumont on Dec. 24, 2011, when suddenly defendant William Gieseke, who was driving in the same lane behind Medina’s vehicle, struck the back of it. Rispetti was riding as a passenger at the time of the collision.
Because of the collision, Medina and Rispetti endured physical impairment, lost wages and their earning capacities, incurred medical costs and suffered disfigurement, the suit states.
They blame Gieseke for causing the collision, saying he negligently failed to keep a proper lookout, failed to properly apply his brakes, failed to control his speed, failed to maintain proper control of his vehicle and failed to take proper evasive action.
In their complaint, the plaintiffs seek unspecified damages, plus pre- and post-judgment interest at the legal rate, costs and other relief the court deems just.
