Service technician files collective lawsuit against Longview company for overtime wages

TYLER - A service technician is suing a Longview company for failing to pay overtime compensation.

Kevin Loessberg, on behalf of him/herself and all others similarly situated, filed suit against Tombell Corp., doing business as Kirby Restaurant & Chemical Supply, and Thomas M. Bell on July 12 in the Western District of Texas, San Antonio Division. The case was removed to the Tyler Division of the Eastern District of Texas on July 30. 

The plaintiff and other employees who were employed as route drivers/service technicians allegedly worked in excess of 40 hours per week, but were not compensated for overtime hours at one and one-half times their regular rate.

The defendant is accused of violating the Fair Labor Standard Act by failing to pay overtime wages.

The lawsuit is seeking an award of damages for unpaid overtime compensation, liquidated damages, attorney’s fees, court costs and interest.

The plaintiff is represented by David G. Langenfeld of Dunham & Jones P.C. in Austin. A jury trial is requested.

U.S. District Judge Michael H. Schneider is assigned to the case.
