Port Arthur local Cynthia Dennis is suing Brothers Body Shop and Wrecker Service, doing business as American Towing, for allegedly wrongfully repossessing her vehicle.
The suit was filed Aug. 21 in Jefferson County District Court.
According to the lawsuit, on Aug. 8, 2012, the defendant took custody of the plaintiff’s 1996 Mercury Cougar. When she requested the vehicle be returned, she was informed it had been disposed of.
The suit maintains the defendant did not act under the authority of extrajudicial authority or creditor and therefore wrongfully repossessed the vehicle.
The suit further accuses the defendant of negligent infliction of mental distress.
The plaintiff is suing for actual damages, loss of use, mental aguish and embarrassment.
