Man claims driver struck vehicle while making U-turn

A Liberty County man claims he suffered severe bodily injuries after a driver attempted to make a U-turn in front of him.

Kevin John Bruns filed a lawsuit Aug. 22 in Jefferson County District Court against Susan Brooks Dupuy.

In his complaint, Bruns alleges he drove his 2000 Toyota west on FM 365 in Jefferson County on Dec. 22, 2011. At the same time, Dupuy had stopped on the east side of the same road next to a mailbox, according to the complaint.

“As plaintiff was proceeding along FM 365 in accordance with the law, defendant made a sudden, unexpected and unsafe u-turn directly in front of plaintiff’s vehicle causing the vehicles to collide,” the suit states.

In addition to his severe bodily injuries, Bruns suffered from a deteriorated physical and mental condition and experienced great physical pain and mental anguish, the complaint says. He also claims he incurred medical costs.

Bruns blames Dupuy for causing the collision, saying she negligently failed to keep a proper lookout, failed to drive in a safe manner, failed to yield the right-of-way, failed to turn only when she was able to do so, failed to apply her brakes in a timely manner to avoid a collision and failed to keep her vehicle under proper control.

In his complaint, Bruns is seeking an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.

Gordon D. Friesz of McPherson, Hughes, Bradley, Wimberley, Steele and Chatelain in Port Arthur will be representing him.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
