Suit claims woman bitten by bat at Home Depot

A shopper has filed a lawsuit claiming she suffered severe mental anguish after being bitten by a bat at Home Depot. 

Lakishia Wiley filed suit against Home Depot U.S.A. Inc., doing business as The Home Depot, on Sept. 9 in the Eastern District of Texas, Marshall Division.

The incident occurred on Jan. 28, 2013, while Wiley was shopping at the Home Depot store in Longview. Wiley alleges she was bitten by a bat when she picked up a cinderblock from an in-store display.

According to the allegations, there have been previous infestations of bats and other wild animals at the Home Depot store.

The defendant is accused of premises liability for failing to warn of, or make safe, dangerous conditions known, or that could be identified by a reasonable inspection by the owner of the premises.

The plaintiff is seeking an award of damages for medical expenses, pain and suffering, mental anguish, disfigurement, physical impairment, interest and court costs.

Wiley is represented by N. Eric Cooper of The Cooper Law Firm in Longview. A jury trial is requested.
